Unregistered Land
We can deal with matters concerning unregistered land including voluntary applications for first registration of title. Our Senior Partner Miss Frances White has over 40 years experience of such matters.
It was recently reported by a Lawyer that he had employed a Law Graduate with an added Masters Degree in Law who told him that during the course of her studies she had only to attend a single lecture on unregistered conveyancing. It is a common occurrence that a buyers solicitors for a property with an unregistered title will advise that to be unacceptable and that the title needs to be registered before they can advise their client to proceed. This is presumably because such conveyancers have no ability to investigate an unregistered title. Many estate agents are also of the opinion that an unregistered title is unacceptable.
In addition, HMLR promotes voluntary registration applications for the following reasons:
- Registration of title offers easy proof of land ownership and greater security of title by reducing encroachment on land.
- Registered titles will save time on property transactions and there is the benefit of guidance from Land Registry when queries arise.
- Land Registry offer a 25% discount on fees for voluntary first registration.
If you own a property which has an unregistered title that you are looking to sell or you want to consider voluntary registration of such a title to your property please contact us. Depending on the nature of the unregistered title our fee for investigating such a title and dealing with an application for first registration will be up to £600 plus VAT and disbursements. There will be some small search fees payable to the Land Registry as well as a registration application fee which varies depending on the value of the property.
